WPGC-FM Mobile Services Terms of Service
These Terms of Service govern the mobile services, including but not limited to, downloads, SMS/text messages, and emails to mobile telephones and devices (“Mobile Services”), provided by HipCricket, Inc. (“HipCricket”) for Radio Station WPGC-FM, Lanham, MD. (“Station”), owned and operated by CBS Radio Inc. of Maryland, a subsidiary of CBS Radio Inc. (collectively, “we” or “us” or “our”). Your use of these Mobile Services constitutes: a) your express consent to receive communications to your mobile telephone and/or device; and b) your acceptance to be bound by these Terms of Service and the Station’s Terms of Use Agreement [make active hyperlink to each Station’s TOU] (“Agreement”)which are hereby incorporated by reference. If at any time you do not accept all the terms and conditions of these Terms of Service and the Agreement, you must immediately discontinue use of these Mobile Services.
YOU MAY NOT USE THESE MOBILE SERVICES FOR ANY PURPOSE THAT IS UNLAWFUL OR PROHIBITED BY THE AGREEMENT. YOUR ACCESS TO THESE MOBILE SERVICES MAY BE TERMINATED IMMEDIATELY IN OUR SOLE DISCRETION, WITH OR WITHOUT NOTICE, IF YOU FAIL TO COMPLY WITH ANY PROVISIONS OF THE AGREEMENT, OR FOR ANY OTHER REASON, OR NO REASON.
Registration to Receive Alerts
By registering for Mobile Services you may receive the listed “DISCOUNTED PRICE” for all mobile downloads, alerts and contests that appear on this website. You can change or update your user profile anytime by returning to this website. The Station may use your Personal Information for our own internal analysis as well as share your Personal Information with our operational service providers, such as HipCricket, who assist the Station in the delivery and operation of the Mobile Services.
By registering, you may receive alerts for station contests, promotional events, and other offers that we believe to be of interest to you, depending on your selection of Mobile Services. Typically, alerts with information from the Station will be sent no more than three times per week but may vary according to the Station’s promotions and events calendar.
How to Stop Receiving Alerts
We provide the following methods to stop receiving alerts:
1. Login to this website and click the unsubscribe link on your profile page.
2. For text alerts only, text the word "STOP" at anytime to the 5 digit shortcode advertised on this website that is associated with the alerts you wish to stop receiving.
3. For email alerts only, click on the unsubscribe link contained in each email message.
4. Send an email to support@hipcricket.com. Your email should clearly state all of the following: your email address and/or mobile telephone number receiving alerts, THE SOURCE OF THE EMAILS OR ALERTS (such as the ‘From’ email address or number or shortcode that sent the text alert, and that you no longer wish receive the email and/or text alerts.
Standard Carrier Charges Apply
standard text messaging rates CHARGED BY YOUR WIRELESS CARRIER will apply in most situations FOR TEXT ALERTS. In the event that charges or fees apply, you agree to pay your wireless carrier the fee that corresponds to the alert or downloads or other Mobile Services in accordance with the fees in effect at the time of your order. Unless otherwise indicated, the charges shall be invoiced on the bill from your wireless carrier. All fees, as applicable, are subject to change upon notice from the Station and/or HipCricket. We will provide you with reasonable notice of such change. All fees are due immediately and are non-refundable, except as otherwise expressly noted.
Premium Charges May Apply
In some circumstances you will be charged more than your wireless carrier's standard rates. This is called Premium SMS or Premium Rate Text Messaging. In these circumstances, any additional charges will be clearly advertised on this website or in the text message communications we send you. Any Premium charges will appear on your next wireless bill, or be deducted from your pre-paid balance.
Requirements to Receive Alerts
A two way text messaging capable telephone and plan is required for text alerts. A valid email address is required for email alerts. An internet connection is required to access your email account. All messages that you receive MAY include a note from a sponsor - in many cases, this sponsorship is included so that we can provide the service FREE to you (except for your wireless carrier charges - we have no control over those!). Text messaging and Premium Rate Text Messaging is not available in all areas and on all wireless carriers within the United States. Contact your wireless carrier for specific details. You are responsible for the provision and maintenance of all equipment and service plans required to receive your alert and to access your accounts.
